OSPI, Special Education expedited rule making for WAC 392-172A-05080
OSPI received a petition for rule making to clarify language in WAC 392-172A-05080, regarding the timeframe for filing a request for a due process hearing. WAC 392-172A-05080 as currently drafted describes the content of a request for a due process hearing, but does not provide a clear description of the timeframe in which a request for a due process hearing must be made. OSPI is using expedited rule making procedures because it is adopting a federal regulation without material change, as permitted by RCW 34.05.353(1)(b). If you object to the use of the expedited rule making process, you must express your objection in writing by 5:00 p.m. on April 5, 2010. Please see the CR-105 for more information. OSPI, Special Education Rule Adoption for WAC 392-172A
OSPI adopted rules on October 1, 2009, which amend certain sections of WAC 392-172A. The final rules were adopted after public and written comment. The rules are effective November 2, 2009, which is 31 days after filing the rule making order.

Annual State Application for Fiscal Year 2009
OSPI amended its annual state
application under Part B of the Individuals with
Disabilities Education Act as Amended in 2004 for Federal
Fiscal Year 2009. This application is now available for
public comment. Please submit your comments in writing to
speced@k12.wa.us, fax to 360-586-0247 or mail to the
Special Education Office, OSPI, PO Box 47200, Olympia, WA
98504-7200 and refer to the Annual State Special Education
Application.
This application is broken
into the following sections: Section I contains the
submission statement. Section II contains assurances
regarding the eligibility requirements for Public Law
108-446 (IDEA 2004) and it contains certifications regarding
compliance with IDEA 2004 and other federal laws governing
federal programs. Section
III is a description of the use of funds under Part B of
IDEA 2004. Section IV
describes State Administration.

ANNUAL STATE APPLICATION FOR
FISCAL YEAR 2008
OSPI
amended its annual state application under Part B of the Individuals with
Disabilities Education Act as Amended in 2004 for Federal Fiscal Year 2008.
As part of the
submission process, the US Department of Education Office of Special Education
Program (OSEP) requires that we publish the application for at least 60 days and
accept public comment for at least 30 days. After posting and receiving comments
on the application, OSPI will: (1) inform OSEP if there are any changes
resulting from the 30-day comment period and (2) inform OSEP when the 60 days of
public availability is completed.
This
application is broken into three sections: Section I contains the submission
