Private Schools & Non-profits — Approved by the State Board of Education

The students, parent/guardians and educators of non-profit, private and religiously-affiliated schools — approved by the Washington State Board of Education — are eligible for benefits provided through several major federal education grant programs. These equitable services can provide a valuable supplement to the core programming and professional development private schools make available.

Private Schools Unit

The Office of Superintendent of Public Instruction (OSPI) established a Private Schools Unit to support the work of federal ESEA programs. This unit will include the responsibilities of the ombuds detailed in ESEA, as amended by ESSA. Contact the Private Schools Unit at 360-725-6100, or email or

Affirmation of Consultation

A tool that guides timely and meaningful consultation between districts and private schools, ensuring equitable services for private school children, teachers, and other educational personnel. Complete an Affirmation of Consultation for each private school participating in federal programs under ESSA.

Title I, Part A Record of Agreed Upon Services

This tool applies only to Title I, Part A participation and serves as a Record of the Agreed Upon Services, resulting from the consultation between the school district and private school. Complete this document for each private school that chooses participation in Title I, Part A.

Compliant Procedures & WAC Update

Districts must provide and explain these complaint procedures to private school officials during the initial consultation process. Please note that OSPI is updating WAC 392-368 for filing a complaint under ESEA to align with the ESSA. Emergency rules were filed May 11 and are in effect until permanent rules are adopted in September.

Consultation for Title IV, Part A Block Grant

Although initial consultations have begun for the 2017–18 school year, some of these conversations are based on “estimated or projected” district allocations, and may create uncertainty about the level of services to private schools. We will notify districts as soon as preliminary allocations for established Title programs are available. We anticipate this will occur close to the end of May.

However, the newly created Title IV, Part A block grant presents another level of uncertainty, as state level funding and program details will not be available until early summer. At this time, we suggest districts set up an agreeable communication strategy to ensure that when Title IV, Part A information is available, it is shared with private schools and consultation can begin on this program.

Equitable Services = Specific, Effective & Allowable
The intent of the Elementary and Secondary Education Act is that districts use their federal grant dollars to design programs and services that meet the individual needs of teachers and students in non-public schools.

Benefits to Private School Students and Teachers is a short publication produced by the U.S. Department of Education that outlines the how equitable services must operate in Title I, II, III, IV, V and VI programs.

Guidance — Uniform Provisions for Equitable Services

Districts that receive federal funds must provide services to eligible students and teachers in private schools. These services and benefits must be 1) delivered in a timely way, and 2) comparable to the services and benefits the district provides to the children and teachers in its public schools.

Every Student Succeeds Act
Non-regulatory Guidance released in 2016 covers programs included in the Every Student Succeeds Act. Specifically addresses the role of the ESSA Private School Ombudsman, new reporting requirements, and calculating equitable services for Title I,A and Title II,A.
